By using our Site or submitting information through it, you agree to the practices described here. If you do not agree, please do not use the Site.

⚠️ Important: HIPAA Notice Is Separate

This Privacy Policy governs information collected through our website. Your protected health information (PHI) maintained as part of your child's medical record is governed by our separate HIPAA Notice of Privacy Practices, which you receive at your first visit and can request anytime from our office.

1. Scope of This Policy

This policy applies to information we collect:

  • On the Site healthychildrenpediatrics.com and any pages we operate.
  • Through online appointment requests, contact forms, and email communications sent to us from the Site.
  • Through cookies and similar technologies used on the Site.

This policy does not apply to:

  • Information collected offline during office visits, phone calls, or paper forms (governed by our HIPAA Notice of Privacy Practices).
  • Third-party websites linked from our Site (see Section 10).
  • Our patient portal or telehealth platforms operated by third parties, which have their own privacy terms.

2. Information We Collect

a) Information You Provide Directly

When you use our appointment booking form, contact form, or email us, we may collect:

  • Full name (of the parent/guardian and/or child)
  • Phone number
  • Email address
  • Preferred appointment date and time
  • Reason for visit or description of your inquiry or concern
  • Any additional information you voluntarily share in messages to us

ℹ️ Please Don't Share Sensitive Medical Details in Web Forms

Standard email and contact forms are not fully secure. Please avoid sharing detailed medical information, diagnoses, or other sensitive health details through the website. For medical questions, call us at +(551) 355-3760 or use the patient portal.

b) Information Collected Automatically

When you visit the Site, we may automatically collect:

  • Device & browser information — IP address, browser type, operating system, device identifiers.
  • Usage data — pages viewed, time spent, referring URL, clicks, and search terms used on our Site.
  • Approximate location (based on IP address).
  • Cookies and similar technologies (see Section 5).

c) Information from Third Parties

We may receive limited information from analytics providers (like Google Analytics) or advertising networks about how visitors reach and use our Site.

3. How We Use Information

We use the information we collect to:

  • Respond to appointment requests, contact inquiries, and questions you submit.
  • Schedule, confirm, reschedule, or cancel appointments at our Elizabeth or Secaucus offices.
  • Communicate with you about your requests, our services, office updates, and practice news.
  • Operate, maintain, and improve the Site's performance, security, and user experience.
  • Understand how visitors use our Site so we can improve content and services.
  • Protect against fraud, unauthorized access, or misuse of the Site.
  • Comply with legal obligations, including healthcare, tax, and records-retention laws.

We do not sell your personal information, and we do not use information collected from the Site for targeted advertising beyond basic analytics described below.

4. How We Share Information

We share information only as described below:

a) With Service Providers

We use trusted vendors to help us run the Site and the practice, such as website hosting, email delivery, appointment scheduling software, analytics providers, and IT support. These providers access information only to perform services for us and are contractually required to protect it.

b) For Legal Reasons

We may disclose information when we believe in good faith that it is necessary to:

  • Comply with a law, subpoena, court order, or other legal process.
  • Protect the safety of our patients, staff, or the public.
  • Investigate or prevent fraud, security issues, or violations of our policies.

c) Business Transfers

If our practice is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction. You will be notified of any such change.

d) With Your Consent

We may share information for any other purpose with your explicit permission.

🛡️ Protected Health Information

If any information submitted through the Site becomes part of your child's medical record, it becomes PHI subject to HIPAA — not just this Privacy Policy. HIPAA disclosures are governed by our Notice of Privacy Practices.

5. Cookies & Tracking Technologies

Our Site uses cookies and similar technologies (such as pixels and local storage) to function properly and to understand how it is used.

Types of Cookies We Use

  • Essential cookies — required for the Site to function (e.g., security, form submission).
  • Analytics cookies — help us understand visitor behavior through tools like Google Analytics (which collects anonymized data on page views, session duration, and navigation).
  • Preference cookies — remember settings you choose on the Site.

Managing Cookies

Most web browsers let you block or delete cookies through settings. Disabling essential cookies may affect Site functionality. You can also opt out of Google Analytics by installing the Google Analytics opt-out browser add-on.

Do Not Track

Some browsers transmit "Do Not Track" (DNT) signals. Because there is no industry-standard way to interpret DNT signals, our Site currently does not respond to them.

6. Children's Privacy (COPPA)

👨‍👩‍👧 A Note to Parents & Guardians

Our Site is designed for parents and legal guardians, not for children. The Children's Online Privacy Protection Act (COPPA) prohibits the knowing collection of personal information from children under 13 without verifiable parental consent.

We do not knowingly collect personal information directly from children under 13 through this Site. Information about a child that is submitted through our forms should only be provided by the child's parent or legal guardian in connection with arranging pediatric care.

If you are a parent or guardian and believe your child under 13 has provided us with personal information directly through the Site, please contact us at healthychildren@gmail.com or +(551) 355-3760. We will promptly delete such information from our records.

Information Parents Submit About Their Children

When a parent or guardian submits information about a child through the Site (for example, while booking an appointment), we use that information only to respond to the request, schedule care, and provide related services. It is not used for marketing to the child.

7. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect the information we collect, including encrypted connections (HTTPS/TLS), access controls, and limitations on staff who can view submissions.

However, no website, email system, or internet transmission can be guaranteed to be 100% secure. We cannot warrant absolute security of information transmitted to or from the Site. For sensitive medical communications, please use the patient portal or contact our office directly by phone.

Data Retention

We retain information collected through the Site only as long as needed to fulfill the purposes described in this policy, comply with our legal and recordkeeping obligations, resolve disputes, and enforce agreements. Medical records are retained according to applicable state and federal laws governing healthcare providers.

8. Your Rights & Choices

Depending on where you live, you may have rights regarding your personal information, including:

  • Access — request a copy of the personal information we hold about you from our website systems.
  • Correction — ask us to correct inaccurate information.
  • Deletion — request that we delete personal information, subject to legal retention requirements for medical records.
  • Opt-out of marketing — unsubscribe from promotional emails at any time via the link in the email or by contacting us.

To exercise these rights, contact us using the information in Section 12. We may need to verify your identity before responding. Rights related to your child's medical record are separately governed by HIPAA.

9. California Residents

If you are a California resident, the California Consumer Privacy Act (CCPA/CPRA) provides additional rights, including the right to know what personal information we collect, to request deletion, to correct inaccurate information, and to opt out of any "sale" or "sharing" of personal information.

We do not sell personal information and do not share it for cross-context behavioral advertising. To submit a verifiable request, contact us at healthychildren@gmail.com. We will not discriminate against you for exercising your rights.

Note that medical information governed by HIPAA is generally exempt from CCPA.

10. Third-Party Links & Services

Our Site may link to other websites we don't operate (for example, patient portals, telehealth providers, insurance carriers, or resource sites). Clicking these links takes you to pages governed by that third party's privacy policy. We're not responsible for the privacy practices of other sites, and we encourage you to read their policies before sharing information.

11. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will post the revised version on this page with a new "Last Updated" date. Material changes will be announced on the Site for a reasonable time. Your continued use of the Site after changes take effect means you accept the updated policy.
